Just Jolly Groups Policy

These Just Jolly Groups Policy ("Policy") govern your use of the Just Jolly platform’s group creation and participation functionalities, and are binding upon you, the user ("You," "User," "Group Creator," or "Participant"). By creating, joining, or participating in any group on Just Jolly (the "Platform"), you expressly acknowledge, agree to, and consent to comply with this Policy, as well as the Just Jolly Terms of Service, Terms and Conditions Governing the Insertion of Code in Just Jolly Posts, and the Just Jolly Privacy Policy (collectively, the "Terms"), which are incorporated herein by reference. If you do not agree to any of the provisions of this Policy or the Terms, you are prohibited from creating, joining, or participating in groups on Just Jolly.

Just Jolly is a platform powered by Incomars Software Services ("Incomars," "we," "our," "us"), a service provider that is a duly registered entity in New Delhi, India. The Policy governs all group creation, management, participation, and associated monetary transactions within the Just Jolly Groups ecosystem. This Policy shall be construed in accordance with the laws of the Republic of India, and all users of the Platform, irrespective of their geographical location, agree to the exclusive jurisdiction of the courts in New Delhi, India.

1. DEFINITIONS AND INTERPRETATION

1.1 Platform: The social networking platform, "Just Jolly," provided by Incomars Software Services, where users can interact, communicate, and engage in various activities, including but not limited to the creation and participation in groups.

1.2 Groups: Refers to user-generated and user-managed communities within the Just Jolly platform, which may be created, joined, or participated in by Users, subject to the terms and conditions herein.

1.3 Group Creator: A User who creates and manages a group within the Platform.

1.4 User: An individual who is registered with the Platform and participates in the activities offered by Just Jolly, including but not limited to creating, joining, and interacting within groups.

1.5 Monetary Charges: The fees that Just Jolly may impose on Users for the creation of groups, which fees shall be non-refundable under any circumstances.

1.6 Terms: The Just Jolly Terms of Service, Terms and Conditions Governing the Insertion of Code in Just Jolly Posts, and the Just Jolly Privacy Policy, these agreements which govern the use of the Platform and which are incorporated by reference into this Policy.

2. PARTICIPATION AND ELIGIBILITY

2.1 Eligibility: To participate in group creation, management, and joining, you must: (a) Be a registered User of the Platform in accordance with the Just Jolly Terms of Service; (b) Be of legal age in your jurisdiction and legally competent to enter into binding agreements; (c) Comply with all applicable laws, rules, and regulations in force in your country and/or region, including but not limited to those concerning online communications, content regulation, and financial transactions.

2.2 Exclusion of Users: Just Jolly reserves the right to exclude or remove any individual or entity from the group creation or participation process at its sole discretion, if it determines, in its judgment, that such exclusion or removal is necessary for legal, security, ethical, or regulatory reasons.

3. CREATION OF GROUPS AND FEES

3.1 Creation of Groups: Users may create groups on the Platform, subject to the availability of the group creation feature and any applicable requirements or limitations. While creating a group is free, Just Jolly may, at its sole discretion, impose monetary charges on Users for the creation of certain groups, including but not limited to specialized, premium, or exclusive groups.

3.2 Monetary Charges: In cases where monetary charges are imposed on the creation of a group, the amount and payment process will be clearly outlined on the Platform. The charge for group creation may be non-refundable under any circumstances.

3.3 Non-Refundable Fees: By creating a group and paying the applicable fee, you acknowledge that the fee paid is non-refundable. Under no circumstances shall Just Jolly be liable for the return or refund of any amounts paid for the creation of groups.

3.4 Changes to Fee Structure: Just Jolly reserves the right to modify, change, or introduce new charges for group creation at any time, without prior notice, and such modifications shall be communicated to the Users via the Platform. Any fees imposed after such changes shall be subject to the new fee structure.

4. USE OF GROUPS

4.1 User-Generated Content: As a User, you are solely responsible for the content you share, post, or otherwise make available within a group, including text, images, videos, or other materials ("Content"). You represent and warrant that you hold all rights to such Content, and that it complies with applicable laws, rules, and Just Jolly’s policies.

4.2 Group Management: The Group Creator shall be responsible for managing the group, including enforcing group rules, monitoring user behavior, and moderating content within the group. Just Jolly shall not be liable for any disputes, conflicts, or content issues that arise within groups.

4.3 Behavioral Expectations: Users are expected to behave respectfully and lawfully within groups. Just Jolly reserves the right to suspend or terminate access to any group for any User who violates the Just Jolly Terms of Service and the Terms and Conditions Governing the Insertion of Code in Just Jolly Posts, these Just Jolly Groups Policy, or engages in illegal or inappropriate conduct.

5. USER CONDUCT AND PROHIBITED ACTIVITIES

5.1 Prohibited Content and Activities: Users are prohibited from posting, sharing, or engaging in any activity that: (a) Violates any applicable law or regulation; (b) Infringes on the intellectual property rights or other rights of third parties; (c) Is fraudulent, defamatory, obscene, abusive, harassing, or offensive; (d) Promotes or engages in illegal activities, including but not limited to fraud, money laundering, or terrorism; (e) Violates the Just Jolly Terms of Service, Terms and Conditions Governing the Insertion of Code in Just Jolly Posts or these Just Jolly Groups Policy.

5.2 Consequences of Misconduct: Any User found in violation of this Policy may have their access to groups restricted or terminated at Just Jolly’s sole discretion. Just Jolly also reserves the right to take appropriate legal action in cases of serious misconduct, including but not limited to reporting to relevant authorities.

6. MONETARY TRANSACTIONS AND REFUNDS

6.1 Monetary Transactions: All payments made by Users for group creation, upgrades, or other premium features are processed through the Platform’s designated payment systems. Just Jolly is not responsible for any issues related to external payment gateways or transaction failures.

6.2 Non-Refundable Policy: All fees associated with group creation or premium group services are final and non-refundable, except as expressly required by applicable law. Users are encouraged to review all details before submitting payments.

6.3 Taxes and Other Charges: Any taxes, duties, or other government-imposed fees applicable to the payment for group creation or related services shall be borne by the User. Just Jolly shall not be responsible for any such charges.

7. MODERATION AND COMPLIANCE WITH APPLICABLE LAWS

7.1 Moderation: Just Jolly reserves the right, at its sole discretion, to monitor, review, and moderate content and user activity within groups to ensure compliance with these policies, and may remove or restrict access to content or groups that violate this Policy.

7.2 Compliance with Laws: Just Jolly operates under the jurisdiction of the Republic of India, and Users must comply with Indian laws and regulations. Global regulations may also apply, including but not limited to the General Data Protection Regulation (GDPR), California Consumer Privacy Act (CCPA), and other data protection laws as applicable.

8. INTELLECTUAL PROPERTY RIGHTS

8.1 Ownership of Content: By creating a group or participating in a group, you grant Just Jolly a worldwide, non-exclusive, royalty-free license to use, display, and distribute any Content you upload in accordance with the Just Jolly Privacy Policy, the Just Jolly Terms of Service, and the Terms and Conditions Governing the Insertion of Code in Just Jolly Posts.

8.2 Infringement: Any infringement of intellectual property rights (such as copyright, trademarks, or patents) within groups is prohibited. Just Jolly may, at its discretion, remove infringing content or take further action as necessary.

9. LIABILITY AND INDEMNITY

9.1 Limitation of Liability: To the fullest extent permissible under applicable law, Just Jolly and its affiliates shall not be liable for any indirect, consequential, incidental, or punitive damages arising out of or in connection with the creation, participation, or use of groups on the Platform.

9.2 Indemnity: You agree to indemnify, defend, and hold harmless Just Jolly, Incomars, and their respective officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses arising out of your use of the Platform, including any violation of this Policy.

10. GOVERNING LAW AND DISPUTE RESOLUTION

10.1 Governing Law: This Policy shall be governed by, and construed in accordance with, the laws of the Republic of India, without regard to its conflicts of law provisions.

10.2 Dispute Resolution: Any dispute arising out of or

in connection with this Policy shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India. The parties consent to the personal jurisdiction of such courts.

11. ACKNOWLEDGEMENT AND CONSENT

By engaging with the Platform and agreeing to participate in group creation, management, and participation, you acknowledge that you have read, understood, and agree to the terms and conditions set forth in this Just Jolly Groups Policy, the Just Jolly Terms of Service, Terms and Conditions Governing the Insertion of Code in Just Jolly Posts, and the Just Jolly Privacy Policy. You also acknowledge that your participation in any group is at your own risk, governed by the legal provisions outlined herein.
