Just Jolly Badges Terms of Service

The following Just Jolly Badges Terms of Service ("Badges Terms of Service") govern your use of the badge services ("Badges") provided by Just Jolly ("Company", "we", "our", "us"), including the process of obtaining, displaying, and utilizing badges on the Just Jolly social networking platform ("Platform"). By acquiring, using, or otherwise interacting with any badges on the Platform, you ("User", "you", "your") expressly acknowledge and agree to these Badges Terms of Service, the Just Jolly Terms of Service and the Just Jolly Privacy Policy (collectively, the "Terms"). You are bound by the Terms as updated from time to time, and failure to comply with the Terms may result in the suspension or termination of your access to the badges or the Platform, in whole or in part.

By continuing to interact with the Badges, you confirm your understanding and agreement that these Badges Terms of Service shall constitute a legally binding contract between you and Just Jolly.

1. DEFINITIONS: 1.1 Badges: Icons, marks, or symbols awarded to users by Just Jolly for various achievements, activities, or verifications on the Platform, including but not limited to badges awarded for program completion, examinations, and the "Verified" badge.

1.2 Verified Badge: A badge granted to a user upon successful verification of their profile, which signifies that the profile is genuine and has undergone a verification process.

2. ELIGIBILITY FOR BADGES: 2.1 Users must be registered and in good standing on the Platform to be eligible for any badges.

2.2 The eligibility requirements for each badge, including but not limited to the "Verified" badge, will be outlined in specific program descriptions or notifications provided by Just Jolly.

3. AWARDING AND OBTAINING BADGES: 3.1 Badges may be awarded by Just Jolly based on the completion of designated programs, examinations, or other criteria established by the Company.

3.2 Some badges may be manually assigned by the Platform’s administration team, while others may be automatically awarded upon meeting predefined conditions.

3.3 The "Verified" badge is available only upon the payment of a fee and the successful completion of the identity verification process. Just Jolly reserves the right to refuse to grant the Verified Badge to any user, at its sole discretion, based on verification failures or policy violations.

4. PAYMENT FOR VERIFIED BADGE: 4.1 The Verified Badge requires payment of a fee, the amount of which will be disclosed at the time of purchase.

4.2 Fees are non-refundable and must be paid in full via accepted payment methods on the Platform.

4.3 Users acknowledge and agree that the Verified Badge is a service provided by Just Jolly and is subject to availability and the terms of the identity verification process.

5. USE AND DISPLAY OF BADGES: 5.1 Badges are granted solely for the purpose of indicating achievement, completion, or verification within the Platform.

5.2 Users are granted a non-transferable, non-exclusive, revocable license to display any badges awarded to them on their Platform profile.

5.3 Just Jolly reserves the right to revoke, modify, or remove any badges granted to a user if Just Jolly determines, at its sole discretion, that the user has violated the Terms, engaged in fraudulent activity, or otherwise misused the Platform.

6. RESTRICTIONS AND PROHIBITED CONDUCT: 6.1 Users shall not engage in any activity that falsely claims, manipulates, or misrepresents the achievement or status related to any badge, including the Verified Badge.

6.2 Users shall not attempt to acquire badges through unauthorized or fraudulent means, including but not limited to, providing false information, using third-party services to manipulate badge awards, or any other unlawful activity.

6.3 Just Jolly reserves the right to take legal action, including the suspension or termination of a user’s account, for any violation of the Terms, including fraudulent or deceptive behavior related to badge acquisition.

7. INTELLECTUAL PROPERTY RIGHTS: 7.1 All badges, trademarks, logos, and other materials associated with Just Jolly and its Platform are the exclusive property of Just Jolly or its licensors. Users are granted no rights or licenses, whether express or implied, to any intellectual property related to the badges.

8. TERMINATION AND SUSPENSION: 8.1 Just Jolly reserves the right to suspend, revoke, or remove any badges from a user’s account if Just Jolly, in its sole discretion, determines that the user has violated these Badges Terms of Service or the general Just Jolly Terms of Service.

8.2 Users may also forfeit their badges upon termination or suspension of their account or if they cease to meet the eligibility requirements for holding a badge.

9. LIMITATION OF LIABILITY: 9.1 To the fullest extent permitted by applicable law, Just Jolly shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use or acquisition of badges, including but not limited to loss of reputation, loss of business opportunities, or loss of data.

9.2 Just Jolly’s total liability in connection with these Badges Terms of Service shall be limited to the amount paid by the user for the specific badge in question.

10. INDEMNITY: 10.1 You agree to indemnify, defend, and hold harmless Just Jolly, its officers, directors, employees, agents, affiliates, and licensors from any claims, losses, damages, liabilities, and expenses (including reasonable attorney fees) arising out of or in connection with your violation of these Badges Terms of Service, your use of badges, or your violation of any rights of third parties.

11. GOVERNING LAW AND DISPUTE RESOLUTION: 11.1 These Badges Terms of Service shall be governed by and construed in accordance with the laws of India.

11.2 Any disputes arising from or relating to these Badges Terms of Service shall be resolved through binding arbitration in accordance with the rules of the Indian Arbitration and Conciliation Act, 1996. The place of arbitration shall be New Delhi, India, and the language of the arbitration shall be English.

12. MISCELLANEOUS: 12.1 Entire Agreement: These Badges Terms of Service, along with the Just Jolly Terms of Service and Just Jolly Privacy Policy, constitute the entire agreement between you and Just Jolly regarding the use of badges on the Platform.

12.2 Severability: If any provision of these Badges Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

12.3 Amendment: Just Jolly reserves the right to amend or modify these Badges Terms of Service at any time without prior notice. Any changes will be effective immediately upon posting on the Platform, and your continued use of the Platform constitutes acceptance of those changes.

13. CONSENT AND ACCEPTANCE: 13.1 By accepting these Badges Terms of Service, you hereby acknowledge that you have read, understood, and agree to be bound by the terms and conditions stated herein.

AGREEING TO THESE TERMS: By agreeing to these Badges Terms of Service, you also acknowledge that you are accepting the Just Jolly Terms of Service and the Just Jolly Privacy Policy, which collectively govern your use of the Platform, badges, and related services.
